Attorney Joseph Cervone has been serving Accident Victims & their Families throughout the state of New York since 1994.
He has recovered millions of dollars for injured clients including a $5,000,000 Wrongful Death Settlement. We put the full
weight of our office behind you so that you receive the compensation you deserve. We fight for your rights in all areas of
personal injury law including:
Wrongful Death:

A devastating death by mis-diagnosis or accident can ruin a family, don't let this happen to yours! My office has
represented many families who have lost their loved ones through the negligence of others and has recovered millions of
dollars for those claims while providing compassionate understanding to the families of the deceased throughout the
process.

Construction Accidents:

If you have you been injured on the job from a fall from heights off a ladder or a scaffold you may be entitled to
compensation beyond having your medical bills and wages paid by workers' compensation. My office has represented many
accident victims who have fallen from heights off of unsecured ladders, or improperly installed scaffolds as well as roofers
who have not been provided the proper safety harnesses from falls.
Medical Malpractice:

We trust Doctors will be as careful as possible, it isn't always the case. Negligence can destroy lives. Doctors can be
responsible for malpractice in different ways such as a misdiagnosing of a condition such as cancer, or deviating from
standard medical practice in the treatment of patients.

Motor Vehicle Accidents:

Accidents involving motor vehicles or motorcycles can happen at any time. Many times when motor vehicle accidents occur people are injured and shaken
up. It is imperative, however, to act swiftly when a motor vehicle accident occurs to get the names and addresses of any
witnesses who identify themselves at the scene. Many times the on-scene investigation takes a significant period of time
which witnesses do not have and they will leave the scene before they speak with law enforcement. It is critical to
retrieve their information on the scene. In addition to obtaining witnesses, it is important to take pictures of the damage
to the vehicles involved in the collision at the scene prior to the vehicles being towed away. Often times, the vehicles will
be deemed a total loss by the insurance companies, and thus be unavailable to be subsequently photographed. My office
handles all aspects of motor vehicle accident cases. This includes advising the client on property damage and assuring the client
receives any lost wages and medical expenses together with fair and just compensation for the injured party's pain and suffering.
Dog Bites:

Was there a warning sign, did the pet owner properly control the dog? Was the pet owner aware of any prior vicious
propensity on the part of the animal? This is particularly important under New York law as a dog is given one free
bite before an owner is responsible for a parties injuries. Therefore, it is imperative to research whether any prior complaints
have been made regarding the animal immediately following an incident. My office has been successful in recovering
monies for individuals who have been bitten by dogs even in instances where the previous bite had not been reported to
the authorities.

Slip/Trip & Fall Accidents:

Property Owners are responsible for maintaining a safe environment for you and your loved ones. Hold them accountable!
If you have been injured from a fall at a grocery store, department store, or at a private premises
through the negligence of another, than it is important to act quickly to preserve the condition that led to your injury. When possible photographs of the accumulation of liquids in a slip and fall matter, or a hole or raise in a floor, walkway, or
parking lot or other dangerous condition resulting in a trip and fall are critical in proving your case. Many times landowners
will clean up the accumulation of liquid or repair a hole or condition that led to your fall immediately following your
accident.
Claims by Infants:

Under New York law, an infant is considered any individual bringing a claim of injury under the age of 18. An infant has the same rights as an adult when injured through the negligence of another. The claim for injury on behalf of an infant, however, must be made by a parent or guardian. Our office has recovered monies for infants injured in motor vehicle accidents, and playground incidents at schools and daycares.

Claims Against Municipalities:

In New York, an individual injured as a result of the negligence of an employee of any governmental entity such as the state of New York, county, or city or town as well as any governmental or municipal subdivision such as a school district can be compensated for his or her injuries. A governmental or municipal entity can be held responsible for the negligence of its employees just as any other private citizen. It is important, however, to know that the time in which to bring a claim against a governmental entity or municipality is shorter than the time provided by law to sue a non-governmental entity or individual. My office has been successful in recovering just and fair compensation for individuals injured through the negligence of governmental or municipal employees.
